About Us

This web site is owned and operated by Scotland Through the Lens who are completely dedicated to your total satisfaction. If you have any suggestions or comments or if you need to contact us, please email us using the link on the store page.
Scotland Through The Lens offers pictures of Scotland for the non profit use (profit use may be sought with prior written consent from Scotland Through The Lens at no additional cost). This site is intended for people who wish to use the photographs for their own personal use, i.e. printed and used in a holiday album, computer screen saver/wallpaper, printed for private decoration, wall hangings etc. Images may also be used for web design, sales, marketing and promotions. The only limitation on images offered is for re-sale in any printed or digital format without prior consent from Scotland Through The Lens. Otherwise please download and enjoy these images offered.

Making A Purchase

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.
We accept all payment through PayPal™, all terms and conditions listed by PayPal's site have to be met by the customer listed under "Legal Agreements for PayPal™ Services". Scotland Through the Lens does not accept failure to comply with PayPal's terms and conditions by the customer and will not enter into any such discussions regarding this issue. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. If you are shopping from North America or anywhere else, place your order and your card company will convert the transaction to US Dollars or your own currency.
If you have made a mistake in your order and cannot correct it in the shopping cart, contact us and we will correct the mistake.
When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Information to third parties, other than when order details are processed as part of the order fulfillment. In this case, the third party will not disclose any of the details to any other third party.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. Terms and Conditions

1. Scotland Through The Lens offers royalty free stock photography for purchase/download. Purchase/download of an image does not entitle ownership of said image that is and will remain solely the property and legal image of Scotland Through The Lens. These images are available for any purpose deemed fit by the Customer excluding re-sale, whether in digital format or printed in any medium without the written consent of Scotland Through The Lens. Images are available for re-printing, marketing and display providing image is labeled as supplied by Scotland Through The Lens.
1.1 This website is operated by Scotland Through The Lens (the Supplier). As user of this website (the Customer), the Customer acknowledges that any use of this website including any transactions the Customer makes is subject to the terms and conditions below.
1.2 Acceptance of the Customer's download/order and the completion of the contract between the Customer and the Supplier will take place on download/order to the Customer of the images downloaded/ordered unless the Supplier has decided that the Supplier does not accept the download/order.
1.4 The Supplier may change these terms and conditions offers without notice to the Customer in relation to future sales.

2. The Website

2.1 The Supplier will use reasonable endeavors to verify the accuracy of any information on the website but makes no representation or warranty of any kind regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs. The Supplier will not be responsible or liable to the Customer for any loss of content or material uploaded or transmitted through the website and the Supplier accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
2.2 To provide increased value to the Customer, the Supplier may provide links to other websites or resources for the Customer to access at their sole discretion. The Customer acknowledges and agrees that the Supplier is not responsible for the availability of such external sites or resources, and does not review or endorse and is not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
2.3 To complete the online transaction the data that you supply may be transmitted across international boundaries.

3. Description and price of the goods

3.1 The description and price of the goods to be downloaded/ordered by the Customer are as stated on this website (which may be varied from time to time.) The Supplier shall not be bound by erroneous prices (all prices on this website are to be construed as an 'Invitation to treat' only). In the event of error the Supplier will endeavor to try and inform the Customer as soon as possible, and give the Customer the option of reconfirming the order at the amended price. If the Supplier is unable to contact the Customer the order will be treated as acceptable, otherwise at the supplier's discretion cancelled. If the Customer cancels and has already paid for the goods, no re-fund will be offered, it is therefore the customers decision whether to accept image offered.
3.2 The goods are offered subject to remaining unsold. If on receipt of the Customer's order the goods ordered are not available, the Supplier will inform the Customer as soon as possible, and offer a suitable alternative image to download/order.
3.3 In addition to the price, the Customer will be required to pay any delivery charge for the goods other than downloaded images, shown at point of sale.
3.4 The Supplier reserves the right not to supply any goods to any person for any reason and shall not be required to give such reason. In this event the Supplier will inform the Customer as soon as possible.

4. Payment

4.1 Payment shall be due in full before the goods are delivered, or images available for download.

Delivery

5.1 The goods ordered by the Customer will be delivered to the delivery address.
5.2 The Customer will be responsible for risk of loss of or damage to the goods once they have been delivered to the Customer.
5.3 In spite of delivery having been made, property in the goods shall not pass from the Supplier until the Customer has paid the price in full and no other sums whatever are due from the Customer to the Supplier.
5.4 The Supplier shall not be responsible for delay or non-delivery caused by circumstances not completely within its control. Delivery dates/times given by the Supplier are target only and shall not be the essence of the contract.
5.5 Claims for non-delivery/download must be received within 24hrs of transaction.

6. Warranty

6.1 All goods supplied by the Supplier (except downloaded images) are warranted free from defects up to delivery only. This warranty does not affect the Customer's statutory rights as a consumer.
6.2 This warranty does not apply to any defect in the goods arising from willful damage, accident, negligence by the Customer or any third party, or any alteration or repair carried out without the Supplier's approval.
6.3 If the goods supplied to the Customer develop a defect while under warranty, or the Customer has any other complaint about the goods, the Customer should notify the Supplier in writing via email address, within 24hrs of warranty expiry.

7. Data protection

7.1 The Supplier will take all reasonable precautions to keep the details of the Customer's order and payment secure, the Supplier will not be liable for unauthorised access to information supplied by the Customer.
7.2 The Supplier will only use the information the Customer provides about the Customer for the purpose of fulfilling the Customer's order, unless the Customer agrees otherwise.

8. Applicable law

8.1 These terms and conditions and the supply of the goods/downloaded images will be subject to Scots law, and the Scottish courts will have jurisdiction in respect of any dispute arising from any transaction.

9. Indemnification

9.1 You agree to indemnify and hold Scotland Through The Lens harmless against all claims or liability asserted against Scotland Through The Lens arising out of or in connection with any breach by you or anyone acting on your behalf of any of these Terms of Use.
9.2 You as the customer acknowledge that whilst Scotland Through the Lens it's agents and representatives have taken reasonable precautions to ensure otherwise the Images may not be free of bugs or errors, viruses, Trojan horses or other harmful mechanisms, may not be a fully comprehensive collections and may contain factual inaccuracies or expressions of personal opinion with which you do not agree.

Acknowledgement

10.1 You acknowledge that you have read this agreement, understand it, and had an opportunity to seek independent legal advice prior to agreeing to it. in consideration of Scotland Through The Lens agreeing to provide the content, you agree to be bound by the terms and conditions of this agreement. You further agree that it is the complete and exclusive statement of the agreement between you and Scotland Through The Lens, which supersedes any proposal or prior agreement, oral or written, and any other communication between you and Scotland Through The Lens relating to the subject of this agreement.
